Third Party Provider Conditions for Groundsure Insights Data
Environment Agency Content
Supply to End User: If the Client supplies Environment Agency content to an End User, the Client shall send full and unamended copies of the Environment Agency content together with a copy of the Groundsure Terms & Conditions, and notify the End User that they must comply with such notice and Terms & Conditions.
Supply to Court/Tribunal: The Client shall be entitled to supply an unaltered, and unalterable, extract of any Environment Agency content in the Groundsure Insights Data to a court, tribunal or regulatory body (but not including a trade association) where the inclusion of such extract is reasonably necessary in connection with a hearing, application or other judicial or regulatory process, provided that such extract is formatted in such a way as to be static.
Restrictions on Use: The Client must (a) comply with any Information Warnings supplied with the Environment Agency content; (b) acknowledge the source of the Environment Agency content by including the following attribution statement: “Contains Environment Agency information © Environment Agency and database right”; (c) not use the Environment Agency content in a way that suggests any official status or that the Environment Agency endorses the Client or its use of such content; (d) not mislead others or misrepresent the Environment Agency content or its source or use the Environment Agency content in a way that is detrimental to the environment, including the risk of reduced future enhancement; (e) not use the Environment Agency content in a way that breaches the Data Protection Act 1998 or the Privacy and Electronic Communications (EC Directive) Regulations 2003; (f) unless otherwise expressly agreed, destroy the Environment Agency content 12 months after receipt.
British Geological Survey
Liability: The Client acknowledges that some of the responses contained in British Geological Survey content are based on data and information provided by the Natural Environmental Research Council (NERC) or its competent body the British Geological Survey (BGS). Your use of any information which is derived from or based upon such data and information is at your own risk. Neither NERC nor BGS gives any warranty, condition or representation as to the quality, accuracy or completeness of such information and all liability (including liability for negligence) arising from its use is excluded to the fullest extent permitted by law.
Copyright:- The Client shall acknowledge the source of the BGS content by including the following attribution statement: “Derived from BGS Digital Data under Licence. British Geological Survey. ©NERC.”
Getmapping PLC
Copies: Unless the Client has purchased a licence directly from Getmapping PLC, the Client shall be entitled to make up to 10 hardcopy reproductions of content provided by Getmapping PLC.
Copyright:- The Client shall acknowledge the source of the Getmapping content by including the following attribution statement: “Aerial photography supplied by Getmapping PLC.© Copyright Getmapping PLC 2003. All Rights Reserved.”
National Resources Body for Wales
Destruction: Unless otherwise expressly agreed, the Client shall destroy the National Resources Body for Wales content 12 months after receipt.
Information Warnings: The Client shall comply with any Information Warnings supplied with the National Resources Body for Wales content.
Copyright:- The Client shall acknowledge the source of the National Resources Body for Wales content by including the following attribution statement: “Contains National Resources Body for Wales information © National Resources Body for Wales and database right”
Ordnance Survey
Application of Additional Terms: In addition to the terms below, the Client shall comply with the Appendices linked to the Groundsure terms and conditions. Appendix 1 is applicable to all use of Ordnance Survey content in Groundsure Insights Data products. The remaining Appendices apply only to certain defined types of client.
No right to digitise: In respect of Ordnance Survey content, the Client is not permitted to digitise any features from, or convert into vector format, any of the following datasets: OS VectorMap Local Black and White Raster, OS VectorMap Local Colour Raster, OSVectorMap Local Colour Raster-Backdrop, 1:25 000 Scale Colour Raster, 1:50 000 Scale Colour Raster and OS MasterMap Imagery Layer.
IP Assignment: Unless otherwise agreed in writing, the Client shall assign to the Ordnance Survey all intellectual property rights in analytic data created by the Client using Ordnance Survey content. The Ordnance Survey shall grant to the Client a royalty free licence to use and retain in perpetuity such analytic data in accordance with the terms of the Groundsure Terms and Conditions.
Term: The Client’s licence to use Ordnance Survey content within a Groundsure Insights Data product begins on receipt of such content and ends 5 years after receipt.
Destruction: The Client shall destroy Ordnance Survey content 5 years after receipt, unless requested to do so sooner by or on behalf of Ordnance Survey or on termination of Groundsure’s licence to supply Ordnance Survey content.
Copyright:- The Client shall acknowledge the source of the Ordnance Survey content by including the following attribution statement: “© Crown copyright and database rights 20XX. Ordnance Survey license 100035207.”
Open Government licence
For Using Information under this licence
Use of copyright and database right material expressly made available under this licence (the ‘Information’) indicates your acceptance of the terms and conditions below.
The Licensor grants you a worldwide, royalty-free, perpetual, non-exclusive licence to use the Information subject to the conditions below.
This licence does not affect your freedom under fair dealing or fair use or any other copyright or database right exceptions and limitations.
You are free to:
- copy, publish, distribute and transmit the Information;
- adapt the Information;
- exploit the Information commercially and non-commercially for example, by combining it with other Information, or by including it in your own product or application.
You must (where you do any of the above):
acknowledge the source of the Information in your product or application by including or linking to any attribution statement specified by the Information Provider(s) and, where possible, provide a link to this licence;
If the Information Provider does not provide a specific attribution statement, you must use the following:
Contains public sector information licensed under the Open Government Licence v3.0.
If you are using Information from several Information Providers and listing multiple attributions is not practical in your product or application, you may include a URI or hyperlink to a resource that contains the required attribution statements.
These are important conditions of this licence and if you fail to comply with them the rights granted to you under this licence, or any similar licence granted by the Licensor, will end automatically.
Exemptions
This licence does not cover:
- personal data in the Information;
- Information that has not been accessed by way of publication or disclosure under information access legislation (including the Freedom of Information Acts for the UK and Scotland) by or with the consent of the Information Provider;
- departmental or public sector organisation logos, crests and the Royal Arms except where they form an integral part of a document or dataset;
- military insignia;
- third party rights the Information Provider is not authorised to license;
- other intellectual property rights, including patents, trade marks, and design rights; and
- identity documents such as the British Passport
Non-endorsement
This licence does not grant you any right to use the Information in a way that suggests any official status or that the Information Provider and/or Licensor endorse you or your use of the Information.
No warranty
The Information is licensed ‘as is’ and the Information Provider and/or Licensor excludes all representations, warranties, obligations and liabilities in relation to the Information to the maximum extent permitted by law.
The Information Provider and/or Licensor are not liable for any errors or omissions in the Information and shall not be liable for any loss, injury or damage of any kind caused by its use. The Information Provider does not guarantee the continued supply of the Information.
Governing Law
This licence is governed by the laws of the jurisdiction in which the Information Provider has its principal place of business, unless otherwise specified by the Information Provider.
Definitions
In this licence, the terms below have the following meanings:
‘Information’ means information protected by copyright or by database right (for example, literary and artistic works, content, data and source code) offered for use under the terms of this licence.
‘Information Provider’ means the person or organisation providing the Information under this licence.
‘Licensor’ means any Information Provider which has the authority to offer Information under the terms of this licence or the Controller of Her Majesty’s Stationery Office, who has the authority to offer Information subject to Crown copyright and Crown database rights and Information subject to copyright and database right that has been assigned to or acquired by the Crown, under the terms of this licence.
‘Use’ means doing any act which is restricted by copyright or database right, whether in the original medium or in any other medium, and includes without limitation distributing, copying, adapting, modifying as may be technically necessary to use it in a different mode or format.
‘You’, ‘you’ and ‘your’ means the natural or legal person, or body of persons corporate or incorporate, acquiring rights in the Information (whether the Information is obtained directly from the Licensor or otherwise) under this licence.
